Desse modo, os autores consideram a mobilização da população na garantia de seus direitos como extremamente necessário para o avanço de SUS, bem como o esclarecimento da população sobre seus direitos, os quais lhe são garantidos enquanto usuários de serviços públicos de saúde. Nos propomos a mostrar, o que consideramos instrumentos jurídicos mais efetivos neste matéria, classificados como instâncias reguladoras de controle a mostrar, o que consideramos instrumentos jurídicos mais efetivos nesta matéria, classificados como instâncias reguladoras de controle social sendo: Ministério Público e Conselho Municipal de Saúde. A partir disso foram feitos estudos retrospectivos de denúncias contra as ações de Saúde do SUS nas duas instâncias reguladoras citadas e um questionário de perguntas aplicado aleatoriamente às pessoas usuárias de vários locais que prestam serviços públicos de saúde, o que veio confirmar a análise a respeito da insatisfação prevalente ao serviço de Saúde (SUS), aliado a uma desinformação de seus direitos e deveres amparados pela constituição. Abstract The Federal Constituin-88 (CF) recognized the health as right of citizenship and created the Sistema Único de Saúde  SUS (Only System of Health), which was regulated in laws 8080/90, it s unique and it works in the same way in all the national territory, however these rights aren t respected always. We have considered to explain, what we have thought more effective legal instruments in this subject, classified as regulating instances of social control: Ministério Público and Conselho Municipal de Saúde. After that had been done retrospective studies of denunciations against the actions of Health of the SUS in the two regulating instances cited and a questionnaire of questions had been made applied on people from many places, that works on public services of health, which confirmed the analysis about the insatisfaction to the service of health (SUS), ally to a disinformation of its rights and duties supported for the constitution.
